The deadline for EEA citizens who were living in the UK before 31 December 2020 to apply to the EU Settlement Scheme (EUSS) was 30 June 2021.
It is possible to make a late application but people in this position may find it hard to prove they have the right to work, rent and claim benefits while their late application is pending.
The government has announced that it aims ‘to provide further reassurance to late applicants that the government will protect their rights until their application and any appeal is decided.’

Joining family members will also have temporary protection for 3 months after their arrival in the UK and pending the outcome of an EUSS application made during that period (and of any appeal).
This should mean that late applicants to the EUSS will still have the right to work and rent if they have a pending late application.
Employers and landlords are being advised to get in touch with the Employer and Landlord Checking Services if they are dealing with someone who has confirmation of a late application to the EUSS.
